Why Gummy Supplement Labels Draw Disproportionate FDA Scrutiny

In the dietary supplement industry, labels are not just marketing tools โ€” they are legal documents. Under 21 CFR Part 101 and the Dietary Supplement Health and Education Act (DSHEA), every element of a supplement label is regulated. For gummy products specifically, FDA investigators and compliance reviewers tend to focus on gummy labels with a heightened level of attention, and there are structural reasons for that.

Gummies are often marketed to broad consumer audiences โ€” children, older adults, and people new to supplementation โ€” which means the FDA pays close attention to how claims are framed, how serving sizes are defined, and whether the product can realistically deliver the stated potency. Unlike capsules or tablets, gummies are manufactured through a highly variable cooking and depositing process. Moisture evaporation during drying, bloom strength shifts in gelatin-based formulas, and pectin gel-setting variability all affect final product weight and density, which directly impacts declared potency per serving.

Because the connection between manufacturing process and label accuracy is so tight in gummy production, FDA investigators use the label as a starting point for deeper inquiry. A label that overstates potency, misdefines serving size, or uses unauthorized claims is not just a paperwork problem โ€” it signals to investigators that the quality system behind it may be equally unreliable. That is why gummy brands must treat label compliance as a manufacturing control issue, not just a graphic design review.

The Five Label Elements FDA Investigators Examine First on Gummy Products

Understanding what investigators look at first gives your QA team a structured place to focus pre-launch reviews. The following five elements generate the most enforcement activity for gummy supplement labels and are routinely cited in FDA Warning Letters and 483 observations directed at gummy manufacturers and brands.

1. Net Quantity of Contents

For gummies, net quantity must appear on the principal display panel and must accurately reflect the total amount of product in the container. This sounds straightforward, but gummy production introduces real compliance risk. Gummies lose moisture during drying and can continue to lose moisture over shelf life if water activity and packaging are not tightly controlled. A net quantity declared at fill weight may not match the actual product weight six months later. FDA requires that net quantity reflect the amount the consumer actually receives, and under-fill โ€” even minor under-fill โ€” is a violation that is easy for investigators to verify with a simple scale.

Your facility should establish a validated final-weight specification that accounts for expected moisture loss during drying, coating (if applicable), and shelf life. Batch records should document actual fill weights per container, and your label should be reviewed against those specifications before approval. If your mogul-deposited or hand-deposited gummies show significant weight variation between batches, that variation needs to be narrowed through process controls before you finalize your label declaration.

2. Supplement Facts Panel Accuracy

The Supplement Facts panel is the most technically complex element on a gummy label, and it is where FDA investigators spend the most time during label reviews. Every ingredient listed in the Supplement Facts panel must meet specific formatting, sequencing, and disclosure requirements under 21 CFR Part 101.36. For gummies, several specific issues arise repeatedly.

First, the declared potency per serving must be supported by finished-product testing โ€” not just by formulation calculations or supplier Certificates of Analysis for raw materials. Because gummy manufacturing involves heat (cooking temperatures for gelatin or pectin systems commonly exceed 200ยฐF), certain active ingredients can degrade during processing. If your formula includes heat-sensitive vitamins such as vitamin C, folate, or B12, your finished-product potency testing must confirm that the declared amount survives the manufacturing process. Overage calculations that have not been validated against actual finished-product data create label accuracy exposure.

Second, serving size for gummy products must be defined in a way that is meaningful to the consumer. FDA regulations require that serving size reflect the amount typically consumed. For gummies sold to adults, a serving of two gummies is common โ€” but if your potency per gummy is low and you are trying to reach a meaningful dose, you may be tempted to define a serving as four or six gummies. Investigators will examine whether the stated serving is realistic and whether the container holds a logical number of servings given that serving definition.

3. Structure/Function Claims and Required Disclaimers

Structure/function claims are one of the most common label violations cited in FDA Warning Letters for dietary supplements, and gummy brands are not exempt. A structure/function claim states that a nutrient or ingredient affects the structure or function of the body โ€” for example, "supports immune health" or "promotes bone strength." These claims are permitted under DSHEA, but they require a specific disclaimer to appear on the label.

The required disclaimer reads: "This statement has not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease." This disclaimer must appear on any label containing a structure/function claim, must be placed prominently, and must be in at least one-sixteenth of an inch type. For gummy products โ€” which often have small, curved, or rounded packaging โ€” fitting this disclaimer legibly on the label is a physical challenge that many brands fail to meet. Investigators will measure type size and assess whether the disclaimer is truly legible or has been minimized to the point of being functionally invisible.

Disease claims โ€” claims that imply the product can diagnose, treat, cure, or prevent a disease โ€” are prohibited for dietary supplements. For gummy products marketed for immune support, sleep, stress, or mood, the line between a permissible structure/function claim and a prohibited disease claim can be thin. Phrases like "fights infection," "treats anxiety," or "cures insomnia" are disease claims regardless of how they are packaged in gummy-friendly marketing language. FDA investigators monitor product websites alongside physical labels, and web-based disease claims are regularly cited as evidence that a product is being marketed as a drug.

4. Identity Statement and Product Name

The identity statement โ€” which tells the consumer what the product is โ€” must appear on the principal display panel. For gummy supplements, this is typically straightforward: "Dietary Supplement" or a more specific descriptor like "Vitamin C Dietary Supplement." However, gummy brands frequently encounter problems when the product name or identity statement implies a drug use or when the word "gummy" is combined with disease-treatment language in the product name itself.

A product called "Sleep Fix Gummies" or "Immunity Cure Gummies" will draw immediate scrutiny because the name implies disease treatment. The identity statement must be truthful, not misleading, and consistent with how the product is formulated. If your product is marketed as a melatonin gummy but the Supplement Facts panel lists melatonin at a dose below what clinical literature would associate with sleep onset, that inconsistency between the product name, the claims, and the actual formula is a red flag during label review.

5. Manufacturer and Distributor Information

Every dietary supplement label must include the name and place of business of the manufacturer, packer, or distributor. For gummy brands that use contract manufacturers, this element often creates confusion. The label must accurately reflect the responsible party โ€” typically the brand owner or distributor โ€” along with a complete domestic address. If you are a brand that sources from a contract manufacturer but sells under your own brand, your name and address must appear on the label. The contract manufacturer's name is not required and should only appear if your agreement explicitly calls for it.

Under 21 CFR Part 111, the label owner is responsible for ensuring that the product meets all label specifications. This means that even if a contract manufacturer produced the gummies, your company is responsible for verifying that the finished product matches the label. Building contract review and finished-product label verification into your supplier qualification program is essential, particularly if you are working with multiple co-manufacturers across different gummy formulations.

Gummy-Specific Manufacturing Variables That Create Label Compliance Risk

Unlike tablet or capsule manufacturers, gummy producers face a unique set of process variables that directly connect manufacturing performance to label accuracy. QA teams at gummy facilities must understand these connections clearly, because a label that was accurate at formula development may become inaccurate by the time the product reaches scale production.

Moisture Loss and Declared Weight

During the drying phase โ€” which for gelatin-based gummies typically involves conditioning rooms or tunnel dryers operating at controlled temperature and humidity โ€” gummies lose a predictable but variable percentage of their deposited weight. The amount of moisture loss depends on the gelatin concentration, the sugar-to-water ratio in the cook, the drying time and temperature, and the ambient humidity of the facility. Pectin-based gummies, which are common in vegan formulations, have different moisture dynamics and may reach equilibrium water activity faster or slower depending on the pectin type and pH used in the cook.

If your label declares net quantity based on pre-drying weight, or if your potency-per-serving declaration was calculated without accounting for moisture loss, you have a structural label compliance problem. The correct approach is to complete process validation that characterizes moisture loss at production scale, establish a final-weight specification that reflects actual post-drying product weight, and confirm that your potency-per-serving declaration is based on finished-product testing at that final weight โ€” not on theoretical formulation calculations.

Overages and Heat-Sensitive Actives

Many gummy manufacturers add overages โ€” additional amounts of active ingredients beyond the declared dose โ€” to compensate for degradation during cooking and shelf life. Overages are a legitimate manufacturing practice, but they require documentation and validation. You must be able to demonstrate, through finished-product testing across multiple batches, that the overage reliably results in a finished product that meets the declared potency at the time of manufacture and at the end of shelf life.

Without validated overage data, your label declaration is either a guess or a liability. If your overages are too high, your finished product may contain significantly more of an ingredient than declared, which is a label accuracy violation. If your overages are too low, your finished product may fall below the declared potency, which is also a violation. FDA investigators who pull finished-product samples for independent testing will compare results against label declarations, and a consistent pattern of under- or over-declaration across batches will trigger enforcement action.

Serving Size Consistency and Gummy Weight Variation

Gummies deposited in mogul systems or through other casting methods are subject to weight variation from piece to piece. While some variation is inherent to the process, excessive variation creates a label compliance problem when serving size is defined by count rather than by weight. If your label declares a serving as "2 gummies" and those two gummies can range from 4.2 grams to 6.8 grams combined depending on which pieces a consumer selects, the actual amount of active ingredient consumed per serving will vary accordingly.

Managing weight variation requires tight process controls during depositing โ€” consistent cook temperature, controlled mold temperature, verified depositing pressure and speed โ€” and in-process weight checks at defined intervals. Your SOPs should specify acceptable weight ranges per piece and what action to take when variation exceeds those ranges. This is both a GMP requirement under 21 CFR Part 111 and a label accuracy requirement under 21 CFR Part 101.

Building a Pre-Launch Label Review Process That Catches Problems Before FDA Does

The most effective way to prevent label-based FDA enforcement action is to implement a structured, documented label review process that happens before your label goes to print and before product ships. For gummy manufacturers, this review should involve at least three independent checkpoints: a regulatory review, a technical review, and a manufacturing verification review.

The regulatory review should evaluate every claim on the label against current FDA requirements โ€” checking that structure/function claims are supported by competent and reliable scientific evidence, that the disclaimer is present and properly formatted, that no disease claims appear anywhere on the label or associated promotional materials, and that all required label elements are present in the required locations and type sizes. This review should be performed by someone with direct knowledge of 21 CFR Part 101 and DSHEA, not just by the marketing team.

The technical review should verify that the Supplement Facts panel accurately reflects the formula as manufactured โ€” including final potency based on finished-product testing, correct ingredient listing and sequencing, and accurate other ingredients disclosure. For gummies, other ingredients commonly include gelatin or pectin, sugar, corn syrup, citric acid, natural flavors, colors, and coating agents such as carnauba wax or beeswax. Each of these must be listed in descending order of predominance by weight. Allergen disclosures โ€” particularly for gelatin sourced from pork or beef, or for products manufactured on shared equipment โ€” must also be reviewed carefully.

The manufacturing verification review should confirm that your production process can consistently deliver a finished product that matches the label. This means reviewing batch records from validation runs, finished-product COAs from an accredited third-party laboratory, water activity data confirming shelf-life stability, and weight-per-piece data confirming that serving size declarations are accurate. If the manufacturing process cannot consistently deliver the label, the label must be revised โ€” not the other way around.

Document all three reviews in a label review record that is retained as part of your quality system. Under 21 CFR Part 111, you are required to establish and follow specifications for the finished dietary supplement, and those specifications must include label accuracy. A documented label review process provides evidence that you met this requirement and gives you a defensible record if FDA ever questions your label compliance.

For brands selling through Amazon, label compliance documentation is also a marketplace requirement. Amazon Seller Central requires that gummy supplement listings accurately reflect the product label, that Supplement Facts panel information matches what is shown in product images, and that any claims made in the listing are consistent with the physical label. Discrepancies between the listing and the physical label are a common trigger for listing suspension, and the same documentation that satisfies FDA review will typically satisfy Amazon's compliance review as well.
